Who is responsible

Kino, Wester, Chamber of Commerce (KvK) number [KVK-NUMMER], email westerk1978@hotmail.com (the Maker), is the controller for the processing of personal data via this portal and in connection with the video footage agreements with artists and organisers.

What data

Account data: name, username, email address and password (stored encrypted).
Data of the Artist: artist name, full name, address or email and, where applicable, booker or management.
Data of the Organiser: name of the organisation or event, Chamber of Commerce (KvK) number, address and the name of the representative.
Data about the event and the agreement: name, date and place of the event, description of the footage, the permitted use, duration, territory and any fee.
Signing data: the name and place entered, signature, date and time, IP address and browser details at the moment of signing.
Footage: video recordings and stills in which you can be seen or heard.
Technical data: login cookies and server logs (IP address, time).

For what purposes and on what legal basis

Drafting, concluding, performing and being able to prove the agreement – performance of a contract (Article 6(1)(b) GDPR (AVG)) and our legitimate interest in being able to demonstrate what was agreed (point (f)).
Making, editing, storing and publishing the Footage within the arrangements in the agreement – performance of the contract (point (b)) and, for the archive, legitimate interest (point (f)).
Contact about your agreement or the Footage – performance of the contract (point (b)).
Securing the portal – legitimate interest (point (f)).
Statutory retention obligations, such as the tax retention obligation where a fee has been paid – legal obligation (point (c)).

Who can see your data

The agreement is an agreement between the Maker, the Artist and the Organiser. The parties to the same agreement can see each other’s details as they appear in the agreement (for example name, artist name, organisation and address) and the name, place and signature with which it was signed. Your email address, IP address and browser details are visible in the proof of signing. Other users of the portal cannot see anything of your agreements.

Beyond that, we only share data where necessary: with our email provider to send messages, with platforms on which Footage is published (only the Footage and the names credited), with a foundation or legal entity to which the archive is transferred (Article 2.3 of the agreement), or where the law requires us to. We do not sell data. The portal runs on our own server in the Netherlands.

How long we keep the data

Signed agreements and the proof of signing: for as long as the Footage or the right of use exists, and for [AANTAL] years after that.
Account data: for as long as your account exists. On request we will delete your account; we will, however, keep signed agreements as proof.
Financial data: 7 years (statutory retention obligation).
Server logs: no more than [AANTAL] months.

Security

The portal can only be accessed via an encrypted connection (HTTPS). Accounts are created only by us. You can only see your own agreements and files. Files are stored in a protected folder.

Your rights

You have the right of access, rectification, erasure, restriction of processing, data portability and objection. Send your request to westerk1978@hotmail.com; we will respond within one month. For Footage that has already been made or published on the basis of a signed agreement, the arrangements in that agreement apply (see also Articles 8 and 10 of it).
